    Terms of Service

    Please read these terms carefully before using our services

    Custom Branded Mats is the trading name of Maseth Enterprises (Pty) Ltd.

    Acceptance of Terms

    By accessing, browsing, or purchasing from Custom Branded Mats ("the Company", "we", "us", "our"), you ("the Customer", "you", "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you must immediately cease using our website and services.

    NO PROMISES OR GUARANTEES

    BRANDED MATS MAKES NO WARRANTIES, REPRESENTATIONS, OR PROMISES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

    • Product durability, longevity, or performance
    • Color fastness, fading resistance, or material quality
    • Suitability for any particular purpose or environment
    • Measurement accuracy or size consistency
    • Image quality, print accuracy, or color reproduction

    ALL PRODUCTS ARE SOLD "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS AND DEFECTS. YOUR PURCHASE CONSTITUTES ACCEPTANCE OF THIS NO-PROMISES POLICY.

    CUSTOM PRODUCTS - ABSOLUTE NO-RETURN POLICY

    ALL CUSTOM PRODUCTS ARE FINAL SALE WITH NO EXCEPTIONS.

    Due to the personalized nature of our custom branded mats, logo mats, photo mats, anti-fatigue mats, signage, and other customized items, we CANNOT accept returns or exchanges under any circumstances, including but not limited to:

    • Change of mind or buyer's remorse
    • Color variations from screen to product
    • Size variations within manufacturing tolerances
    • Design elements that were approved by the customer
    • Customer errors in design approval or specifications

    By placing an order for custom products, you explicitly acknowledge and agree that the item is made specifically for you and CANNOT BE RESOLD. This policy is strictly enforced to protect Custom Branded Mats from financial losses.

    CUSTOMER RESPONSIBILITIES

    You agree to the following responsibilities:

    • Design Approval: You are solely responsible for reviewing and approving all design proofs before production begins.
    • Measurement Verification: You must verify all measurements and specifications before approving custom orders.
    • Proper Use: You are responsible for using products according to their intended purpose and care instructions.
    • Maintenance: You must follow all care instructions to maintain product condition.
    • Address Accuracy: You are responsible for providing accurate shipping addresses. Custom Branded Mats is not liable for delivery failures due to incorrect addresses.
    • Inspection: You must inspect products upon delivery and report any manufacturing defects within 48 hours.

    LIMITATION OF LIABILITY

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRANDED MATS SHALL NOT BE LIABLE FOR:

    • Any direct, indirect, incidental, special, consequential, or punitive damages
    • Loss of profits, revenue, data, business opportunities, or anticipated savings
    • Personal injury or property damage resulting from product use or misuse
    • Delays caused by third-party couriers, customs, or shipping providers
    • Color variations, size tolerances, or manufacturing variations within industry standards
    • Damage caused by improper use, storage, maintenance, or cleaning

    MAXIMUM LIABILITY: In any event, Custom Branded Mats' total liability to you shall not exceed the amount you paid for the specific product giving rise to the claim. This limitation applies regardless of the legal theory and even if we have been advised of the possibility of such damages.

    INDEMNIFICATION

    You agree to indemnify, defend, and hold harmless Custom Branded Mats, its owners, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

    • Your use or misuse of our products
    • Your violation of these Terms of Service
    • Your negligent or wrongful conduct
    • Your failure to follow care instructions or warnings
    • Any claims by third parties arising from your actions

    GOVERNING LAW & DISPUTE RESOLUTION

    GOVERNING LAW: These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.

    DISPUTE RESOLUTION: Any dispute arising from these Terms or your use of our services shall be resolved as follows:

    • Step 1: Informal negotiation (30 days) - Contact us to attempt resolution
    • Step 2: Mediation - If negotiation fails, mediation through accredited mediator
    • Step 3: Litigation - Only if mediation fails, in South African courts

    NO CLASS ACTIONS: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

    SHIPPING & DELIVERY DISCLAIMERS

    ALL SHIPPING TIMES ARE ESTIMATES ONLY. Custom Branded Mats does not guarantee delivery dates or times. The following disclaimers apply:

    • Production times are estimates and may vary based on order volume and complexity
    • Delivery times are estimates provided by third-party couriers and are not guaranteed
    • Custom Branded Mats is not liable for delays caused by couriers, customs, weather, or other factors beyond our control
    • Customers are responsible for providing accurate shipping addresses
    • Custom Branded Mats is not liable for packages lost or damaged by third-party couriers
    • International customers are responsible for all customs duties, taxes, and import fees

    PRODUCT USE & SAFETY DISCLAIMER

    PROPER USE: You are solely responsible for using our products safely and appropriately for their intended purpose.

    • Follow all care instructions provided with the product
    • Do not use products in ways they were not designed for
    • Inspect products regularly for wear and replace when necessary
    • Keep products away from heat sources, sharp objects, and chemicals

    NO MEDICAL CLAIMS: Anti-fatigue mats are designed for comfort only and make no medical claims. They are not medical devices and do not prevent or treat any health conditions. Consult a healthcare professional for medical advice.

    INTELLECTUAL PROPERTY

    All content on our website, including but not limited to text, graphics, logos, images, designs, and software, is the property of Custom Branded Mats and is protected by South African and international copyright, trademark, and other intellectual property laws.

    • You may not reproduce, distribute, or create derivative works without written permission
    • Customer-provided designs remain your property, but you grant us license to produce them
    • Custom Branded Mats reserves the right to use product images for marketing unless you request otherwise in writing

    MODIFICATIONS TO TERMS

    Custom Branded Mats reserves the right to modify these Terms of Service at any time without prior notice. Your continued use of our website and services after any modifications constitutes acceptance of the modified terms. It is your responsibility to review these terms periodically for changes.

    FINAL ACKNOWLEDGMENT

    BY PLACING AN ORDER OR USING OUR SERVICES, YOU ACKNOWLEDGE THAT:

    • You have read and understood these Terms of Service
    • You accept the NO-PROMISES policy for all products
    • You understand the ABSOLUTE NO-RETURN policy for custom products
    • You accept the 6-month limited warranty terms
    • You agree to the limitation of liability and indemnification clauses
    • You are responsible for proper use, care, and maintenance of products

    These terms are legally binding and protect Custom Branded Mats from financial losses and legal liabilities. No exceptions will be made to these policies.
